By accessing or using Earntrack ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

Earntrack is a sales commission management platform that allows organizations to track deals, manage commission plans, calculate payouts, and generate reports for their sales teams.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• You must be at least 18 years old to use the Service.

4. Subscription and Billing

• The Service is offered under paid subscription plans (Starter, Growth, Scale) with monthly or annual billing cycles.
• All fees are charged in advance and are non-refundable, except as required by law.
• We reserve the right to change pricing with 30 days' prior notice. Price changes take effect at the start of your next billing cycle.
• If payment fails, we may suspend access to the Service until the balance is resolved.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to other users' accounts or data.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse-engineer, decompile, or disassemble any aspect of the Service.
• Use the Service to store or transmit malicious code or harmful content.

6. Data Ownership

You retain all rights to the data you input into the Service. We do not claim ownership of your business data, including deals, commission plans, or financial records. We use your data solely to provide and improve the Service, as described in our Privacy Policy.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for any downtime, data loss, or damages resulting from service interruptions.

8. Limitation of Liability

To the maximum extent permitted by law, Earntrack and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

• You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
• We may suspend or terminate your access if you violate these terms, with notice when reasonably possible.
• Upon termination, you may request an export of your data within 30 days.

10. Changes to These Terms

We may modify these Terms of Service at any time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised terms.

11. Governing Law

These terms are governed by and construed in accordance with the laws of France. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France.
